Welcome to Quibble.

These Terms of Service (“Terms”) govern your access to and use of the Quibble platform, including its mobile applications, website, and all associated services (collectively, the “Platform”), operated by QB Technologies AG (“Quibble,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms.

Eligibility


Summary

You must be 13+ to use Quibble, 18+ for mature content. Underage users need guardian consent. Misrepresenting age may lead to account termination.

1.1 Minimum Age. You must be at least 13 years old to use the Platform. If we learn that someone under 13 is using Quibble Services, we will terminate their account.

1.2 Parental Permission. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

1.3 Age-Restricted Content. Access to content designated as mature, explicit, or otherwise age-restricted is limited to users who are at least eighteen (18) years of age. By accessing or engaging with such content, you represent and warrant that you meet the applicable age requirement.

1.4 Age Verification. As of the last update of these Terms, we do not conduct identity verification and age screening beyond the information provided by users. You are solely responsible for ensuring that your access to age-restricted content complies with applicable laws and with these Terms. We disclaim all liability for any access to such content by individuals who misrepresent their age or otherwise circumvent age restrictions.

1.5 Enforcement. We reserve the right to take enforcement action if we determine that an account has violated these requirements.

Account Registration and Responsibility


Summary

Most content requires a Quibble account. You must register with accurate info, keep your login secure, and are responsible for all activity under your account.

2.1 Account Requirement. Access to content is limited on Quibble's website and its Services without being logged into a Quibble account. Services refers to all features, tools, content, and functionalities made available through Quibble.

2.2 Registration and Security. To get the most out of the Platform, you must register for an account on Quibble. You agree to provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify Quibble immediately at [email protected] if you become aware of any unauthorized use of your account or any other breach of account security.

Platform Access and Use


Summary

You may use Quibble for personal reading or authorized publishing. No illegal use, rights violations, interference, or reverse-engineering is allowed.

3.1 License Grant. Subject to these Terms, Quibble grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes, or, where applicable, for the publication or sale of literary content through appropriate and authorized features.

3.2 Prohibited Uses. You agree not to:

  • Access or use the Platform for any unlawful purpose.
  • Upload or share any content that violates applicable laws, infringes on third-party rights.
  • Interfere with the operation, security, or integrity of the Platform or any other users.
  • Attempt to reverse-engineer, decompile, or otherwise derive source code from any part of the Platform.

User Content and Intellectual Property


Summary

User content (reviews, comments, feedback, etc.) may be used broadly by Quibble under license. Authors keep ownership of works, granting Quibble a non-exclusive license for digital use, subject to separate Publishing Terms.

4.1 User Content License. When you submit reviews, comments, discussions, feedback, and other contributions not intended for commercial publication ("User Content"), you grant QB Technologies AG a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable license to host, store, display, publish, perform, transmit, reproduce, distribute, index, and otherwise use such content in connection with the operation, promotion, and improvement of the Platform and its services. This license is broad and unrestricted to allow Quibble to use User Content as needed for the functioning and growth of the Platform.

4.2 User Content Responsibility. You are solely responsible for all content you submit and for the consequences of its publication or distribution on the Platform. We may, but are not obligated to, moderate or remove content that we believe violates our policies or applicable law.

4.3 Author Content and License. Manuscripts, excerpts, cover art, or any other literary or creative work uploaded for the purpose of publication, distribution, or promotion on the Platform ("Author Content") remain the property of the Author. Authors published on Quibble grant QB Technologies AG a non-exclusive, worldwide, sublicensable (solely for purposes consistent with the operation, promotion, and distribution of the Quibble Platform and related services, and not for independent commercial exploitation by sublicensees) license to use, reproduce, distribute, publicly display, make available, communicate, publish, advertise, and otherwise make commercial use of the Work in digital form, in whole or in part, for so long as the work remains published on the Platform. Authors may request removal of their works at any time; upon removal, the license terminates, except that Quibble may retain archival copies for compliance and legal purposes, and that promotional material published prior to removal may remain accessible.

4.4 Monetization. This license is royalty-free unless and until an author participates in a Monetization Program. Quibble may, at its sole discretion, introduce one or more monetization programs in the future; no author has any entitlement to participation in or continuation of any such program.

4.5 Publishing Terms Govern Author Works. For authors whose works are published on the Platform, the scope of this license and all matters relating to rights management, moral rights, removal procedures, compensation, and commercial use are governed by Quibble's Publishing Terms, which are incorporated into these Terms by reference. In the event of any conflict between these Terms and the Publishing Terms with respect to an author's works, the Publishing Terms will prevail.

Quibble's Intellectual Property


Summary

All rights to Quibble's software, design, databases, and trademarks belong to QB Technologies AG. You may not copy, modify, or use them without explicit written permission.

5.1 Platform Rights. All rights in and to the Platform itself — including its software, architecture, databases, design, features, functionality, logos, graphics, and underlying code — are and remain the exclusive property of QB Technologies AG. These materials are protected by copyright, trademark, and other applicable intellectual property laws.

5.2 Prohibited Uses. You may not copy, modify, distribute, or create derivative works from any part of the Platform except as expressly permitted by us in writing.

5.3 Trademarks. The name "Quibble," our logos, and any other marks, trade names, or brand identifiers displayed on the Platform are trademarks or registered trademarks of QB Technologies AG. You may not use them without our prior written authorization.

Payments and Paid Services


Summary

Some Quibble features require payment under our Payment Policy. Prices or billing may change, with reasonable notice given before updates take effect.

6.1 Paid Features. Certain features of the Platform may require payment. Your purchase and use of any paid service are subject to our Payment Policy. You are encouraged to review the Payment Policy carefully prior to making any purchase.

6.2 Pricing Changes. We reserve the right to modify our pricing or billing procedures at any time, with reasonable advance notice.

Copyright Complaints and DMCA Compliance


Summary

Quibble respects IP rights and follows a DMCA-style takedown process. You can request removal of infringing content; repeat offenders may face suspension or termination.

7.1 Voluntary DMCA Compliance. Quibble and its Services respect the intellectual property rights of others and expects users of the Platform to do the same. Although Quibble is operated by QB Technologies AG, a company based in Switzerland and not subject to the U.S. Digital Millennium Copyright Act ("DMCA") by law, we voluntarily adhere to a DMCA-style notice-and-takedown procedure to protect copyright holders and to maintain a safe and legally compliant environment for user-generated content.

7.2 Reporting Infringement. If you believe that any content hosted or made available through Quibble and its Services infringes your copyright or other intellectual property rights, please submit a detailed report to [email protected], so that we can investigate and take appropriate action. We take these claims seriously and will act swiftly to address valid concerns.

7.3 Repeat Infringers. We reserve the right to remove or disable access to content upon receipt of a valid notice and to take appropriate action against repeat infringers, including account suspension or termination, at our discretion.

Disclaimers


Summary

Quibble is provided "as is" without warranties. We do not guarantee uninterrupted or error-free service. Use is at your own risk and responsibility.

8.1 No Warranties. The Platform and all services provided through it are made available on an "as is" and "as available" basis, without any representations or warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Platform will be uninterrupted and error-free. You use the Platform at your own risk, and you assume full responsibility for your interactions with content and other users. For the avoidance of doubt, this disclaimer does not apply to Quibble's obligations which are expressly stated in these Terms.

Prohibited Conduct


Summary

Quibble bans illegal use, stealing content, reverse engineering, unauthorized commercial use, and harassment. Violations may lead to suspension, termination, or legal action.

9.1 General Prohibitions. Quibble is a space for readers and authors to engage with books and stories in a respectful, safe, and legally compliant environment. To protect that space, we require all users to refrain from any of the following actions while using the Platform:

  • Do not break the law. You may not use the Platform to violate any applicable laws or regulations, infringe upon the rights of others (including intellectual property rights), or breach any legal obligation or contract you are bound to.
  • Do not misappropriate user content. You may not reproduce, modify, translate, distribute, or create derivative works of any content published by others without the express authorization of the content's rights holder.
  • Do not reverse engineer or tamper with our software. You may not decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code or underlying structure of any part of the Platform, including any algorithms, systems, or intellectual property.
  • Do not exploit Quibble for commercial gain. You may not sell access to the Platform, use it for unsolicited advertising or promotions, or exploit it for any unauthorized commercial purpose.
  • Do not harass or bully others. You may not use the Platform to intimidate, threaten, abuse, or otherwise engage in behavior that disrupts the safety or dignity of other users, whether through reviews, messages, comments, or any other feature.

9.2 Enforcement. Quibble reserves the right to investigate violations of these Terms, suspend or terminate access to any user who engages in prohibited conduct, and take legal action where appropriate.

Limitation of Liability


Summary

Quibble is not liable for indirect, incidental, or consequential damages. Aggregate liability is capped at amounts paid in the prior 12 months or CHF 500. Gross negligence and wilful misconduct are not excluded.

10.1 Exclusion of Indirect Losses. To the maximum extent permitted by applicable law, including Article 100 of the Swiss Code of Obligations, Quibble shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to these Terms or your use of the Platform, including loss of profits, loss of data, loss of goodwill, loss of opportunity, reputational damage, or any business interruption, whether arising in contract, tort, or otherwise.

10.2 Aggregate Liability Cap. To the maximum extent permitted by applicable law, Quibble's total aggregate liability to you arising out of or in connection with these Terms, howsoever arising, shall not exceed the total amounts paid by you to Quibble in the twelve (12) months immediately preceding the event giving rise to the claim. Where no such amounts have been paid, Quibble's total aggregate liability shall not exceed CHF 500.

10.3 Swiss Law Mandatory Liability. Nothing in these Terms excludes or limits Quibble's liability for: (i) wilful intent (Absicht) or gross negligence (grobe Fahrlässigkeit) pursuant to Article 100(1) of the Swiss Code of Obligations; or (ii) death or personal injury caused by Quibble's negligence or wilful act or omission. Nothing in these Terms affects any rights you may have that cannot be excluded under applicable mandatory law.

10.4 Class Action and Collective Claims Waiver. To the fullest extent permitted by applicable law, each party agrees that any claim, dispute, or controversy arising out of or relating to these Terms must be brought and resolved solely on an individual basis. You hereby waive any right to bring, join, or participate in any class, collective, consolidated, representative, or multi-party action or proceeding against Quibble in any court or before any tribunal. This waiver applies regardless of the form of action and regardless of whether the claims are framed in contract, tort, statute, or any other theory. Nothing in this Section affects claims that cannot lawfully be waived under applicable mandatory law.

Indemnification


Summary

You agree to indemnify and hold Quibble and its team harmless from any claims, losses, or costs arising from your use of the Platform, your content, or any breach of these Terms.

11.1 Indemnification Obligation. You agree to defend, indemnify, and hold harmless Quibble and its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (i) your use of or access to the Platform; (ii) any content you submit, upload, or transmit through the Platform; (iii) your breach of these Terms; (iv) your infringement of any third party's intellectual property or other rights; or (v) any misrepresentation made by you.

Account Deletion and Termination


Summary

You can permanently delete your Quibble account anytime. Your profile will be removed, but comments and posts stay anonymized. Quibble may also suspend or terminate accounts at its discretion.

12.1 Account Deletion. You may request permanent deletion of your Quibble account at any time through our account deletion page. When your account is deleted, your profile will no longer be visible on Quibble, but your comments and posts will remain on the Platform in anonymized form.

12.2 Quibble's Right to Terminate. We reserve the right to suspend or terminate your account, or restrict your access to the Platform, at any time and for any reason we deem appropriate. Where possible, we will notify you via the email linked to your account or upon your next login attempt.

Modifications to Terms


Summary

Quibble may update these Terms at any time. Material changes will be notified by email at least 30 days before taking effect. Continued use of the Platform means you accept the revised Terms.

13.1 Right to Modify. Quibble reserves the right to modify these Terms at any time. Where we make a material change to these Terms, we will notify you by email to the address registered to your Quibble account at least thirty (30) days before the change takes effect, and may additionally publish a notice on the Platform. A change is "material" if it affects your substantive rights or obligations under these Terms. Continued use of the Platform after a material change takes effect constitutes your acceptance of the revised Terms.

Miscellaneous


Summary

These Terms form the full agreement between you and Quibble. They are governed by Swiss law with exclusive jurisdiction in Zug. Includes force majeure, dispute resolution, assignment, data protection, and other general provisions.

14.1 Entire Agreement. These Terms of Service, together with Quibble's Publishing Terms (where applicable), Content Guidelines, Payment Policy, and Privacy Policy, constitute the complete and exclusive agreement between you and Quibble concerning your use of the Platform. They supersede and replace any prior agreements, understandings, or representations — written or oral — between you and Quibble regarding the Services.

14.2 Force Majeure. Quibble shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Quibble's reasonable control, including without limitation acts of God, natural disasters, pandemic or epidemic, war, terrorism, civil disturbance, cyberattack, failure of third-party telecommunications or infrastructure services, governmental action or regulation, or changes in applicable law. Quibble will use reasonable endeavors to resume normal performance as soon as such circumstances cease.

14.3 Assignment. Quibble may assign or transfer these Terms, in whole or in part, to any affiliate or successor entity, or in connection with any merger, acquisition, or sale of all or substantially all of Quibble's assets, without your consent. Quibble will provide reasonable advance notice of any such assignment. You may not assign or transfer these Terms without Quibble's prior written consent.

14.4 Data Protection. Quibble processes personal data in accordance with its Privacy Policy and the Swiss Federal Act on Data Protection (FADP). The Privacy Policy forms part of these Terms. By creating an account and using the Platform, you acknowledge and consent to the processing of your personal data as described in the Privacy Policy, to the extent required by applicable law.

14.5 Dispute Resolution. Before commencing any legal proceedings, either party must notify the other of the nature of the dispute and the relief sought. The parties agree to negotiate in good faith for a period of thirty (30) days to seek to resolve the dispute before resorting to litigation, unless interim relief is required to prevent irreparable harm. Formal notices to Quibble must be sent in writing to [email protected].

14.6 Governing Law. These Terms are governed by, and shall be construed in accordance with, the laws of Switzerland, in particular the Swiss Code of Obligations and the Swiss Federal Act on Data Protection, without giving effect to any conflict of laws principles that would require the application of the laws of any other jurisdiction.

14.7 Jurisdiction. The courts of the Canton of Zug, Switzerland, shall have exclusive jurisdiction to hear and determine any dispute, controversy, or claim arising out of or in connection with these Terms. Each party irrevocably submits to the exclusive jurisdiction of those courts. This submission to jurisdiction is without prejudice to any mandatory consumer protection rules that may apply in the jurisdiction of residence of a consumer user.

14.8 Severability. If any provision of these Terms is or becomes invalid, illegal, or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the economic intent and purpose of the original provision.

14.9 Waiver. No failure or delay by either party in exercising any right under these Terms shall constitute a waiver of that right, and no single or partial exercise of any right shall preclude any other or further exercise of that right or any other right. Any waiver must be given expressly in writing.

14.10 Electronic Contracting. By creating an account and accepting these Terms through the Platform's registration process, you are entering into a legally binding contract with Quibble. Electronic acceptance constitutes your agreement for the purposes of these Terms and Swiss contract law.

14.11 Good Faith. In accordance with Article 2 of the Swiss Civil Code, both parties shall perform their obligations under these Terms in good faith. Neither party shall exercise any right conferred by these Terms in a manner that constitutes a manifest abuse of right within the meaning of Swiss law.

14.12 Language. These Terms have been prepared in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.
